HCJ 2088/10 - HaMoked: Center for the Defence of the Individual et al. v. Commander of West Bank et al. Petition for Order Nisi

Petition by HaMoked and 11 other human rights organizations to revoke a new military procedure for the “settlement” of Palestinians from the Gaza Strip in the West Bank. The procedure institutionalizes the separation between the Gaza Strip and the West Bank and disrupts the fabric of life of the residents of the Occupied Territories. It is illegal and constitutes a severe violation of Israeli and international humanitarian law. It violates, among others, the right of protected residents to movement and family life and the military’s duties under international humanitarian law to ensure the normal lives of the protected residents of an occupied territory.
