HCJ 726/08 – Al-'Adlouni et al. v. Commander of the Army Forces in the West Bank Petition for Order Nisi

HaMoked petitions HCJ in a demand to allow four minors who have been alone in the Gaza Strip for over four months to travel to Ramallah and join their parents. The father relocated to Ramallah in 2007 following an employment placement. The mother went there to receive medical treatment for her rare systemic inflammatory disease (Behcet). The children's duress is severe - away from their parents and living in the harsh conditions of the Strip. The military's conduct exceeds any acceptable norm. The military is violating the family's right to have a proper life together and ignores the children's best interest.
