HCJ 6579/08 Quablan et al. v. Commander of the Military Forces in the OPT

HaMoked’s petition in the matter of a Palestinian living in the West Bank with her young daughter, who wishes to enter the Gaza Strip to visit her ailing husband who lives there. She was told that she could get a “one way, single use” permit to the Gaza Strip if she pledges never to return to the West Bank. HaMoked stresses that the military commander may not initiate demographic changes in the occupied territory. HaMoked claims, inter alia, that the forcible transfer of protected civilians is prohibited and considered a war crime.
