HCJ 3774/07 - Salamah v. The Commander of the Army Forces in the West Bank Petition for an Order Nisi

HaMoked's petition to allow the passage of a Sharia Appeals Court Judge from the Gaza Strip to the West Bank and back: The Petitioner manages and supervises the Sharia Courts' alimony funds in the West Bank and Gaza Strip. The funds operate as a single unit and are designated to ensure pensions are paid to women and children who do not receive alimony. The Petitioner must personally collect vital data in order to implement the program in the Palestinian Territories and tailor it to the needs of the local population. However, the military authorities are preventing his passage to the West Bank, thereby impeding his work as a judge and harming the population which is supposed to be protected by the state of Israel in its capacity as occupying power.
