Following HaMoked petition: the military disclosed previous procedures on the burial of Palestinians’ bodies it is holding

On 27.7.17, HaMoked petitioned the High Court of Justice to instruct the military to disclose the procedures on the treatment and burial of Palestinians’ bodies, formulated between 1971-1998 and mentioned in the 1999 Arditi Inquiry Commission report. The petition comes after the military archive rejected HaMoked's request, on the grounds that “this is classified material with security sensitivity.” HaMoked argued that there was no basis or logic to the contention that transferring the old orders could threaten state security, when the current valid orders had already been given to HaMoked, under a Freedom of Information request. HaMoked added that it seemed the state was clinging to this absurd contention to obscure and cover up its failures in handling the bodies. HaMoked added that the right to know – underlying the petition – was a basic right and one of the foundations of a free and democratic society.

Following the petition, on 27.8.2017 the state said that it was withdrawing its previous decision and provided in full all the procedures requested.
