HaMoked's new position paper: the Citizenship and Entry into Israel Law, which the Israeli Cabinet has now extended for the fifteenth time, must be revoked

Since its enactment over a decade ago, the Citizenship and Entry into Israel Law (Temporary Order), 5763-2003, has been extended annually. On February 10, 2014, HaMoked published a position paper, calling on the government to cancel the Law and stop extending further. In its position paper, HaMoked argued, inter alia, that the Temporary Order is unconstitutional, and given its repeated extensions, its definition upon enactment as a temporary arrangement has proved to be a deception. HaMoked stressed that most of all, the Law harms children and persons in difficult humanitarian situations; HaMoked recalled the repeated occasions in which the court had criticized the state and instructed the legislator to quit its policy of a sweeping freeze of family unification processes.

Despite the court’s criticism, on March 19, 2014, the government decided to extend the validity of the Temporary Order for another year. That same day, after a brief discussion, the Knesset approved the Law’s extension, now for the fifteenth time.
