HCJ 2828/16 - Abu Zid et al. v. Military Commander of IDF Forces in the West Bank et al. Urgent Petition for Order Nisi and Interim Injunction

HaMoked's petition against the state's intention to demolish the family home of a man suspected of involvement in a shooting and stabbing attack in the Old City of Jerusalem. HaMoked requests the Court to expand the panel and discuss the principled matter of punitive home demolitions. HaMoked claims that, while a request for an additional hearing in the principled petition against punitive home demolitions was rejected six months previously, in light of several judgments that have accrued since then, in which six HCJ justices expressed disagreement with the use of Regulation 119, it is necessary to hold an additional hearing on the issue in an expanded panel. In addition, HaMoked claims that the decision to demolish the home of 10 people is disproportionate.
