HCJ 4597/14 - 'Awawdeh et al. v. West Bank Military Commander Petition for Order Nisi and Interim Order

HaMoked's petition against the military's intention to partially demolish the house in Idhna village where a suspected assailant's nuclear family lives. In the entire house live 13 people, many of them minors. HaMoked asserts that the intended demolition contradicts international law's prohibition on collective punishment, and also Israel's Basic Law: Human Dignity and Liberty; that punitive house demolition does not meet the test of proportionality; that the security establishment has already concluded that this practice is detrimental and does not achieve deterrence; furthermore, that in any event, the demolition must not be carried out without seeking a professional opinion about its anticipated impact on the rest of the structure and its surroundings.
