MApp 4506/08 - Ajaj v. State of Israel Decision

Decision on an appeal by a Palestinian from Ramallah, suspected of use and possession of stolen vehicles and parts, filed against the Magistrates' Court's decision to extend his detention until the end of proceedings. The appeal is dismissed. The District Court rules that an OPT resident may be tried in Israel for an offense committed in the Palestinian Authority, concerning possession and use of suspected stolen property. As to the arguments of contradictory charges and abuse of process, the judge rules they should not be reviewed in the framework of a remand procedure, and must be left to the panel of judges presiding over the indictment itself.
