HCJ 8731/09 - ‘Azam et al. v. Commander of the West Bank et al. Judgment
Judgment in a petition by a Palestinian registered with a Gaza Strip address to instruct the military to allow her return to the West Bank to complete her academic studies in Bethlehem University. The petition is dismissed. The justices rule that under the policy practiced by Israel for some time before August 2005 – when the petitioner entered the West Bank – "entry of Gaza residents to the West Bank for the purpose of academic studies is not approved." The Court has previously reviewed the policy, and found no cause to intervene. The justices add that court intervention remains unnecessary despite the special circumstances of this case.
