HCJ 3969/06 - al-Harub, Head of Deir Samit Village Council et al. v. Commander of the IDF Forces in the West Bank et al. Judgment
Judgment in a petition by ACRI challenging the travel restrictions imposed on Palestinians in the vicinity of the Beit ‘Awwa intersection, prohibiting their travel - on foot and by car - on Road 3256 which crosses the Beit ‘Awwa intersection, in the segment between the Green Line to the west and the Palestinian village of Fuqeiqis to the east. The petition is granted. The justices rule that the order issued by the military commander, whereby the breadth road is closed to Palestinian movement, is disproportionate and extremely injurious to the rights of the local residents.
