HCJ 4019/10 - HaMoked: Center for the Defence of the Individual et al. v. Military Commander of the West Bank et al. Petition for Order Nisi
Court Documents | 4019/10 | 25.5.2010

Petition by HaMoked and 15 other human rights organizations, to instruct Israel to cease its policy of forced deportations of Palestinians from their homes. The organizations demand that Israel be ordered to update the copy of the Palestinian population registry it holds, because its refusal to do so violates the Interim Agreement and legislation on the subject of population registry. The organizations demand that Israel cease the forced removal of people living in the West Bank to the Gaza Strip based on their addresses in the copy of the population registry held by Israel, because it does not have the authority to do so in international or military law. Such removal violates the residents' right to choose their place of residence in their own country, stemming from Israeli and international law.

Human Rights organizations to the High Court of Justice: Stop immediately the expulsion of Palestinians from the West Bank to the Gaza Strip
HaMoked together with 15 other Israeli and Palestinian human rights organizations, filed a joint petition to the HCJ: Israel must immediately stop the expulsion of Palestinians from the West Bank to the Gaza Strip based on their incorrect registration in a Gaza Strip address.
Unacceptable practice of the military transforms the West Bank into a closed zone which applies only to Palestinians : the military does not enforce the order regulating Israelis' entry to the West Bank, and settlers in their hundreds of thousands live there without the required permits
The Palestinian Supreme Court rules: the Palestinian Civil Affairs Committee must accept Palestinians' notices on change of residence from Gaza to the West Bank in the Palestinian population registry, despite opposition by Israel
Judgment in two general petitions filed by HaMoked: HCJ recommends broadening the criteria for “settlement” in the West Bank by Palestinians from the Gaza Strip and instructs the state to explain why it should not refrain from forcibly removing to Gaza Palestinians who moved to the West Bank before 2005
The HCJ has issued an interim order preventing the deportation to Gaza of a youth based on his incorrect address listing in the population register: the youth has traveled outside of his town for the first time in two years
Israel continues to pursue its policy of separation between the West Bank and the Gaza Strip: the Coordinator of Government Activities in the Territories presents a revised procedure for the passage of Palestinians from Gaza to the West Bank for the purpose of relocation, which proves to be no less draconian than the original procedure (02) 627 1698   (02) 627 6317
