HCJ 2820/07 - Sliman v. Commander of the IDF Forces in the West Bank Petition for Order Nisi

HaMoked filed a petition on behalf of a Palestinian who had been detained for over three years after being caught with no ID card. The petition called for his release and the cancellation of the deportation order issued against him. Over the entire course of his detention, the detainee was never brought before a court for judicial review of his detention, nor was the deportation order he was told was issued against him ever presented to him. During the detention, the military attempted to deport him to Jordan, but local authorities there refused to allow him in. In the petition, HaMoked stated that the military was mistreating the Petitioner because he had no status in the West Bank. The military was breaching its duty to fulfill the detainee's rights, denying his freedom without having examined alternative means, and trampling over his dignity as human being. Following the petition, the detainee was released and the deportation order was cancelled.
