HaMoked's petition to allow a Palestinian resident of the Territories to visit her spouse who is incarcerated inside Israel: The Respondent claims that it is doubtful that the Petitioner is married to her spouse as the last name that appears in her marriage contract is different from that appearing in her ID card. In the past, following HaMoked's letter which explained that this was the custom and that the Respondent was aware of this, the application for a visit was approved. However, the Respondent is currently ignoring her requests to renew the permit. HaMoked estimates, in light of past experience, that the Respondent is again under the impression that the Petitioner is not married to her husband. This was the case in other incidents where relatives of inmates were requested to provide proof of the family relation after it had already been proven with supporting documents. By ignoring the Petitioner's application, the military is violating the couple's right to family life, respect, and prison visits – all protected constitutional rights. Following the petition, the Petitioner received a permit to visit her husband.
