AP (Jerusalem) 1238/04 - Jubran at al. v. Minister of Interior et al. Judgment

Court for Administrative Affairs' judgment in HaMoked's petition against the decision not to upgrade the status of a Jerusalem resident's children to permanent residency and revoke the temporary status of one of them. The Court rules that the interior ministry must upgrade the children's status to permanent residency. The Court also rules that in order to determine whether an applicant is entitled to Israeli status, his case should be considered from the application-submission date, rather than the date of the decision, as the state argued. The court also holds that in the absence of criminal or security claims against the status-seeking minor, the child-registration process requires that the applicant ultimately be granted permanent status.
