AP (Jerusalem) 612/04 – Dahud et al. v. Minister of Interior et al. Petition for Order Nisi

Petition by HaMoked against the respondents’ refusal to reach decision on the petitioner’s request to extend her visa as part of the family unification procedure. The respondents failed to act in accordance with their rules, whereby an extension is to be given if, within three months from the day the request is submitted, the couple meets the conditions set by the ministry. The great delay violates the fundamental rights of the petitioner – as well as those of many like her – to family life and dignity, and the respondents’ failure subjects her to detention and deportation. For this reason, a system-wide solution is also requested. It should be mentioned that, one month after the petition was filed, the request for an extension was granted. The respondents contend their approval “was unrelated to the filing of the petition.”
