HCJ 2732/05 - Head of the 'Azzun City Council et al. v. the State of Israel et al. Application under the Contempt of Court Ordinance

HaMoked's application under the Contempt of Court Ordinance, in its petition against the route of the separation wall near the villages of 'Azzun and An Nabi Elyas. The application seeks to compel the respondents to uphold the Order Absolute issued on 4 September 2007 in this matter. Over two years ago, the Court ruled that the segment of the route under discussion was illegal and should be dismantled, yet the State has been stalling the building of the wall on the new route and the dismantling of the illegal segment. HaMoked claims that a state authority's disregard for a court ruling is one of the gravest dangers for the rule of law.
