HCJ 2732/05 - Hassin et al. v. Government of Israel et al. Petition for Order Nisi

HaMoked's petition against the route of the separation wall running near the villages Azzun and Nabi Ilyas. The route in this area does not serve a security need, and is intended to enable the future expansion of the settlement Tzufin towards the east. The route in this area robs hundreds of acres of agricultural lands belonging to residents of the villages. Completion of the wall seriously harms the livelihood of the residents, who struggle to reach their lands and cultivate them. The petitioners state that the entire wall is contrary to international law - based, among other things, on the Advisory Opinion of the International Court of Justice - and Israeli law, and that the route selected for it in the aforementioned area does not pass the proportionality test.
