HCJ 2056/04 - Beit Surik Village Council et al. v. Government of Israel et al. Petition for Order Nisi and Interim Order

Petition to cancel land requisition orders issued for the purpose of erecting the separation wall in the Petitioners' plots and for the cancellation or alteration of the portion of the wall's route passing through them. the Petitioners claim, inter alia, that the planned wall would turn their villages into enclaves within the West Bank and sever them from thousands of dunams of their land and from nearby towns and villages. This will infringe their property rights and their right to freedom of movement, as well as cause harm to their sources of livelihood. The lives of those living in the vicinity of the wall may be in danger due to military activity in the area. The Petitioners also claim that the orders were issued with no authority, that the Petitioners were not given sufficient opportunity to be heard or enough time to prepare their objections to the orders, that the maps attached to the orders were deficient and unclear and that the work on the wall began before the hearing procedure was over.
