HaMoked's tort claim on behalf of the family of the assailant in the attack at the Sbarro restaurant in Jerusalem in 2001, whose home was demolished by the military, causing considerable damage to property. The plaintiffs claim that the demolition was carried out without a demolition order and without a hearing, as required by law. Moreover, aside from the demolition itself, which is prohibited under international law as collective punishment and reprisal against protected persons and their property, the soldiers also caused extensive damage to structures, vehicles and fruit trees near the demolished house, for which the state must compensate the plaintiffs.
The Jerusalem Magistrates' Court denied a tort claim submitted by HaMoked on behalf of the family of the perpetrator of the attack on the Sbarro restaurant in 2001, whose house was demolished by the army: The Court ruled that the demolition was conducted in a professional and considerate manner and with the maximum degree of care, unparalleled in other armies (02) 627 1698   (02) 627 6317
