HCJ 7015/02 - Ajuri et al. v. IDF Commander in the West Bank et al. Response on behalf of the Respondents

State response in a petition submitted by relatives of assailants in attacks, against whom expulsion orders to the Gaza Strip have been issued. The State asks the Court to reject the petitions, claiming the Israeli Government decided to expel relatives of assailants, who were involved in terror activities, as a method which might contribute to the fight against attacks, saving human lives. This method stems both from a deterrent consideration, for those who are considering committing attacks, and a preventative one, referring to people who were involved in terror circles. The state claims that the decision is reasonable and proportional, and appropriately balances the different considerations, and is in accordance with national and international law.
