HCJ 6696/02 - 'Amar et al. v. IDF Commander in the West Bank Judgment

Judgment dismissing HaMoked's petitions on behalf of families of Palestinians who perpetrated attacks against Israelis. The HCJ rules that before it demolishes a house, the military can choose not grant the right to a hearing if there is serious concern that the hearing might jeopardize the soldiers' lives or the operation's success. The court thus transfers to the military the authority to grant or deny the right to a hearing even in cases of punitive action against civilian targets, rather than operational activities in response to attacks against the military or civilians. Following the judgment, HaMoked filed a motion for a further hearing, which was rejected by the HCJ (see in Hebrew HCJFH 7551/02 and 7206/02).
