Adalah's petition challenging the constitutionality of the new law that prohibits the granting of residency or citizenship status to Palestinians from the Occupied Territories who are married to Israeli citizens.The petition challenges the legality of the new law prohibiting the granting of citizenship or residency status to Palestinian residents of the Occupied Territories who are married to Israeli citizens. The law harms, without granting a right to be heard, families who prior to enactment of the law had filed requests for residency in Israel, and as such violates due process and is thus unconstitutional. The law also violates, on ethnic grounds, the constitutional rights to family life, dignity, equality, and privacy of Arab citizens of Israel who are generally those who marry Palestinian residents of the Occupied Territories. The petitioners contend that the objective of the law is not security related, and that the legislator was not provided any reliable factual grounds on the need for the law or on its ramifications.
