At least two Lebanese detainees are currently being held in the secret facility: HaMoked contacted the state and demanded that attorneys on its behalf be permitted to visit the detainees immediately. HaMoked’s request was rejected by the state. At the same time, HaMoked requested that an urgent hearing be scheduled in the petition concerning Facility 1391; this petition still awaits a ruling by the HCJ

On 8 August 2006 HaMoked contacted the State Prosecutor’s Office and demanded that attorneys on its behalf be permitted to visit Lebanese individuals captured by Israel. The detention of the Lebanese citizens was reported in the press. 

In response to this request, the state announced that, as of the date of its reply, two Lebanese detainees were being held at Facility 1391, and that notification on this matter had been forwarded to the High Court of Justice (HCJ), ex parte, on 6 August 2006 (in accordance with the HCJ's decision of 22 January 2006 (Hebrew): “if the need arises, prior to the granting of the ruling in the petition, to use the facility for the interrogation of detainees, notification will be delivered to the court ex parte, in advance, immediately, or retroactively, and we shall decide therein.”) 

The state added that it was possible that additional detainees would be held at the facility. Accordingly, HaMoked again contacted the State Prosecutor’s Office and demanded that attorneys on its behalf be permitted to visit the detainees immediately, within the facility or elsewhere, as had been promised and implemented in the past. This request was rejected by the state: “Regarding additional Lebanese detainees currently in interrogation, at this stage it has been decided by the bodies empowered therefore by law to postpone their meeting with an attorney.” 

HaMoked also demanded to know the status of these detainees and when, if at all, they would be brought before a judge. No reply was forthcoming regarding this demand. 

HaMoked also submitted a request for an urgent HCJ to hearing, in the presence of both sides, in the petition submitted on the subject of Facility 1391. The petition is still pending the HCJ's ruling.
