HCJ 145/80 Jam'iat Iscan Al-Ma’almoun v. Minister of Defense from - Judgment

Judgment in a petition by a Palestinian association whose goal was to build housing for teachers north of Jerusalem. The petition was filed after individual building permits granted by the administrative authorities were retroactively cancelled once an Israeli plant in the Atarot area complained about the Palestinian neighborhood’s proximity. The HCJ found the cancellation lawful as the permits were granted unlawfully in contravention of planning principles. Overlooking the authorities’ responsibility for granting the permits, the court places the responsibility on the petitioners who, it contends, attempted to deceive the authorities by submitting individual applications for the homes without stating these were part of a future neighborhood.
