HCJ 393/82 Jam'iat Iscan Al-Ma’almoun v. IDF Commander in the Judea and Samaria Area - Judgment

Judgment in a petition against the requisition of the petitioner's lands for road construction, forming part of the plan to build two highways inside the West Bank connecting main cities to Israel. The respondents claim the road will serve the communities around Ramallah and Jerusalem, and point out the need to renovate the old West-Bank road system. The Court emphasizes that the military commander must weigh the interests of both the military and the local civilian population in the occupied area, but never his country's national, economic or social interests. The Court accepts the respondents' claims that widening Road 443 will benefit the local population, and approves the land seizure.
