The petitioners contend that the reason for the delay in handling the request, submitted by one of the petitioners, for temporary status, resulted from the respondent’s foot-dragging, and is unrelated to security matters, as claimed. When a concern arose that the applicant constituted a security risk, the procedure set by the Interior Ministry did not call for delay in handling his request, but for rejection. The petitioners also contend that, in other cases the respondent upgraded the status of applicants for family unification despite Government Decision 1813 when requests had been submitted prior to the government’s decision, and the lack of a decision on them resulted from governmental bureaucracy and delay. They again note that the petitioner-applicant had never been arrested or questioned for any offense, and that the government’s decision should not be enforced against him retroactively.
