HCJ 5031/09 Daya v. GOC Central Command et al. Petition for Order Nisi
HaMoked’s petition to allow an East Jerusalem resident to enter Gaza where she lives with her husband under the “divided family” procedure which allows non-Gazan spouses of Gazans to remain in Gaza with renewable entry permits. The petitioner left Gaza a month and a half ago to visit family in Jerusalem, and, despite a clear procedure on this matter and her clarification that her daughter, who is due to give birth needs her, the military has been ignoring her requests to return to Gaza for a month. In so doing, the military is breaching its obligations under international humanitarian law and violating the petitioners’ and her family’s rights to family life, parenthood and the rights of the child.
