HCJ 7733/04 - Mahmud ‘Ali Nasser et al. v. Commander of IDF Forces in the West Bank Judgment

Judgment in HaMoked's petition to prevent the demolition of the home of the assailant in the attack at Café Hillel in Jerusalem. The petitioners argued that using Regulation 119 of the Defense (Emergency) Regulations was illegal, contrary to international law, and was essentially a punitive rather than deterrence measure. The respondents announced the decision to suspend the policy for the time being and examine the source of the power for house demolition, and that if it was decided to renew the demolition policy, it would be done in accordance with the principles set forth by the court, and subject to giving the petitioner the right to be heard.
