House demolition for "security needs": the case of MA
12307/98 | documents: 2  |  Updates: 0 On July 15, 1991, military forces arrived at MA's home in the village of 'Ein Qiniya in the Ramallah area. MA was not at home at the time. Despite her absence, the soldiers broke in, instructed a few village youths to remove some of the household items outside, and proceeded to demolish it to the ground without presenting a demolition order. HaMoked contacted the military legal advisor on MA's behalf, demanding explanations and clarifications as to the grounds for the demolition. Fourteen months later, the military delivered HaMoked a copy of the demolition order which stated that stones were routinely thrown from the house at Israeli vehicles. The order further stated that "the owners of the structure are entitled to […] receive financial compensation for the demolition".

HaMoked, therefore, applied to the military legal advisor demanding to order MA be compensated for her home, as per the demolition order. However, the protracted negotiations which followed, accompanied by stalling on the part of the military, ended with no agreement. In July 1998, HaMoked filed a civil claim on MA's behalf over the demolition of her home. After two more years, with frequent deferrals and out-of-court negotiations, the parties reached a settlement, following which MA received some NIS 73,000 in compensation, over nine years after her home was demolished.
